LEGAL NOTICE: These Terms & Conditions are a binding agreement. By accessing this site, purchasing registration, submitting payment, completing a waiver, or participating in any event-related activity, you acknowledge you have read, understand, and agree to these Terms. If you do not agree, do not purchase or participate.
1) Event Overview
The Lost Prairie Boogie (“Event”) is operated by Meadow Peak Skydiving (“MPS”, “we”, “us”, “our”). Participation is voluntary and subject to these Terms, the Registration Terms, the signed waiver, all posted rules, staff instructions, and all applicable laws and regulations, including Federal Aviation Regulations (FARs).
2) Registration & Payment
Registration is not confirmed until payment is successfully processed. Purchasing registration does not guarantee participation, jump privileges, aircraft access, load priority, or a specific number of jumps.
The standard Event registration fee is $115. From time to time, we may offer discounts or promotional pricing. All pricing is final at time of purchase. We do not provide price adjustments or credits for future promotions, discounts, or price changes.
3) Digital / Event-Based Service Delivery
Event registration is a digital / event-based service, not a physical good. Delivery occurs immediately upon purchase in the form of a confirmed registration record and associated event access eligibility (subject to waiver, safety, and operational requirements).
4) Refund Policy (Non-Refundable)
All registrations are non-refundable.
This includes, without limitation: personal schedule changes, travel issues, illness or injury, no-shows, early departure, weather delays/cancellations, aircraft maintenance, staffing limits, operational interruptions, schedule changes, or reduced jump opportunities.
Refunds may be considered only in rare and unique circumstances, solely at our discretion. Submitting a request does not guarantee approval. Documentation may be required. Approval of one request does not create precedent.
5) Transfers
Registration transfers may be permitted only with prior written approval from MPS. Transfers are not guaranteed and must be requested before the Event. Any replacement participant must complete their own registration and waiver.
6) Waiver, Eligibility, Currency & Safety Discretion
All participants must complete and sign the required waiver (including any onsite verification/physical signature required) before participating. Payment does not substitute for waiver completion or safety eligibility.
Participants must meet all applicable requirements, including licensing, currency, and safety standards (including USPA guidance where applicable). MPS may deny or revoke participation or jump privileges at any time for safety, compliance, medical, behavior, currency, intoxication, or operational reasons, without refund.
Participants are responsible for ensuring their registration information matches the information used to complete the waiver. We are not responsible for delays or operational impacts caused by mismatched or incorrect participant information.
7) Jump Tickets, Fuel Surcharges & Increased Costs
Jump tickets are separate from the Event registration fee. Jump ticket pricing may change at any time.
MPS reserves the right to adjust jump ticket pricing due to fuel surcharges, increased operating costs, aircraft maintenance requirements, staffing costs, regulatory requirements, supply constraints, or other circumstances beyond our control.
Pricing changes apply prospectively and do not create any right to refunds, credits, or price matching for prior purchases.
8) Weather, Operations, Scheduling & No Guarantees
Skydiving is inherently weather-dependent. Weather, wildfire smoke, winds, aircraft availability, staffing, airspace restrictions, and safety conditions may delay, limit, or suspend operations at any time. Event schedules and activities may change without notice.
Registration does not guarantee any specific jump volume, schedule, aircraft access, load priority, or jump opportunity. No refunds or credits are provided due to weather or operational limitations.
9) Conduct, Rules & Compliance
Participants must comply with all FARs, MPS rules, posted policies, and staff instructions. Harassment, unsafe behavior, intoxication, illegal activity, tampering with aircraft/equipment, or refusal to follow staff direction may result in immediate removal and denial of participation, without refund.
10) Personal Property & Equipment
Participants are solely responsible for their equipment and personal property. MPS is not responsible for loss, theft, or damage.
11) Media Release
By attending the Event, you grant MPS permission to capture and use your image, likeness, name, voice, and appearance in photographs, video, and audio recordings for promotional, informational, or documentary purposes without compensation, unless prohibited by law.
12) Force Majeure / Events Beyond Our Control
MPS is not responsible for delays, cancellations, limitations, or changes caused by events beyond our reasonable control, including but not limited to: weather, wildfire smoke, FAA restrictions, airspace closures, government orders, fuel shortages/surcharges, supply constraints, or aircraft availability.
13) Event Modification or Cancellation
MPS may modify, postpone, or cancel any portion of the Event due to safety, operations, weather, aircraft, staffing, or other factors. If the entire Event is cancelled, our liability is limited to the registration fee paid, unless otherwise stated in writing by MPS.
14) Chargebacks, Payment Disputes & Evidence Consent
Initiating a chargeback or payment dispute does not override these Terms. Unauthorized chargebacks may result in cancellation of registration, denial of participation, and restriction from future events.
By purchasing registration, you agree that these Terms, the Registration Terms, the purchase records, and the completed waiver may be used as evidence in response to any payment dispute or chargeback.
15) No Insurance Provided
Participants acknowledge that MPS provides no personal accident or medical insurance covering participants. Participants are responsible for their own medical coverage and all costs arising from injury, illness, or emergency treatment.
16) Limitation of Liability (Site & Commerce)
To the fullest extent permitted by law, MPS shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of this website, the registration purchase, or participation in the Event.
17) Governing Law, Venue & Severability
These Terms are governed by the laws of the State of Montana. Any dispute shall be resolved exclusively in Flathead County, Montana, unless arbitration or other forum selection is stated in the signed waiver.
If any provision is found unenforceable, the remaining provisions remain in full force and effect.
18) Entire Agreement & Updates
These Terms, together with the Registration Terms and the signed waiver, constitute the entire agreement regarding registration and participation. We may update these Terms from time to time. The version in effect at the time of purchase applies to that purchase.
Final Acknowledgement: By purchasing registration, you acknowledge registration is non-refundable, waiver completion is required, jump ticket pricing may change due to fuel surcharges or increased costs, and jumping opportunities are not guaranteed due to weather and operational conditions.
